General Terms and Conditions
1. Business deal
Reservations can be made by contacting Fifty-Eight via Internet. With the enrolment the customer is accepting a contract between him and Fifty-Eight. With the completion of a contract the customer will get an email as an acknowledgement of receipt. There shall be no binding contract until the advance payment has been received by Fifty-Eight.
2. Payment
2.1 The contract is booked and confirmed only on receipt of 150,- Euro per participant. This advance payment is due within fourteen (14) days of confirming the arrangements. Failure to remit your advance payment on time will result in an automatic change of status of any confirmed space to a provisional basis and the possible inability to reinstate your reservation. When the Company receives your advance payment, a booking email will be in your mailbox. The sum takes into account.
2.2 The rest has to be paid 2 weeks before departure.
3. Package deal
Which packages are agreed by contract, you can check in the service and course descriptions of the Homepage of Fifty-Eight. Any special arrangements have to be handled out and to be confirmed by Fifty-Eight.
Fifty-Eight has the right to change the packages because of unforeseeable, legitimate and serious reasons. If Fifty-Eight is NOT able to make your complete travel arrangements for the customer, he will be particularly noticed. Fifty-Eight offers an alternative travel plan which the customer can refuse.
4. Withdrawal, Booking (transfer)
4.1 At any time before the journey, the customer can withdraw from his contract or rebook it. Fifty-Eight will make every effort to arrange any changes requested after the booking has been confirmed, providing it is more than 21 days before departure. After this time no changes can be made. Any cancellation or rebooking must be in writing and shall only be effective upon its acknowledged receipt by Fifty-Eight.
The customer has to explain the withdrawal to Fifty-Eight. Fifty-Eight has to charge a cancellation fee. The scale of charges, expressed as a percentage of the booked price, is as follows.

• Cancellation received more than 60 days notice before departure – 50,- Euro.
• Cancellation received from 59 to 30 days before departure, cancellation charges will be 20% of the booked price.
• Cancellation received from 29 to 15 Days – 40% of the booked price.
• Cancellation received from 14 to 7 days – 70% of the booked price.
• Cancellation received from 6 to 0 days before departure – 100 % of the amount (of the course, the journey, etc.)
5. If the customer doesn’t take all the package he has booked
(because of illness or resting), Fifty-Eight is not responsible for any financial refunds. Fifty-Eight cannot be liable for any penalties or losses incurred as a result of voluntary or involuntary changes to transportation schedules.
6. Withdrawal and cancellation by Fifty-Eight
Fifty-Eight has the right to withdrawal the contract before or after the journey in following cases:
6.1 without any period of notice. If the customer is disturbing sustainable the course (, the journey) or other camp guests, Fifty-Eight has the right to withdrawal the contract without any period of notice and without any financial refunds for the customer.
7. Cancellation of the Contract due to Unexpected Circumstances
If the journey or the course is seriously disturbed because of unexpected circumstances, the company Fifty-Eight or the customer can withdrawal the contract. If the contract is cancelled by the customer, Fifty-Eight has the right to get financial refunds.
8. Liability
The liability of Fifty-Eight is not including the risks which are involved with the sport of surfing. The customer has to be aware of this risks and damages caused by him or other participants of the course or journey. The customer will receive help and advice from the Fifty-Eight team but all activities are undertaken at his own risk. Fifty-Eight and his employees cannot be responsible for any action or event that occurs after its said employees and agents have exercised their duty and taken the necessary care. For losses and damaged property of the customers Fifty-Eight is not liable.
Furnishings, fittings and the rent material has to be treated seriously. Damages caused by negligence and losses, the customer takes the liability for.
9. Customer Conduct
In case of circumstances the Customer has the duty to act helpful and in a law-abiding manner.
10. Insurance
Fifty-Eight recommends to purchase full coverage travel and health insurance. This insurances are not including the cancellation fee which will be charged by Fifty-Eight in case of withdrawal by the customer.
11. Complaints and Claims
Shall you feel unsatisfied with any service Fifty-Eight has provided, please notify Fifty-Eight to avoid the potential for similar problems happening again during your journey.
In the event of a complaint or claim for compensation, the customer must inform Fifty-Eight by email, regular mail, or facsimile in writing within 30 days from the end of your tour. Fifty-Eight will not be liable for any claims made later than 30 days after the completion of your tour.
12. Governing Law and Jurisdiction
For the exclusive benefit of Fifty-Eight, Fifty-Eight shall retain the right to bring proceedings as to the substance of the matter in the courts of the country of the customer’s residence or, where these Terms are entered into in the course of customer’s trade or profession, the country of customer’s principal place of business.
